Summary
- A short "promotion" law, not a rulebook. Its purpose is better lives and a stronger economy through AI research and use, while handling risks.
- Creates the AI Strategic Headquarters: chaired by the Prime Minister, with all cabinet ministers as members.
- Requires an AI Basic Plan. The first was decided by Cabinet on 23 Dec 2025; a second plan followed on 14 Jul 2026 with a focus on agentic AI, "AI Transformation", and a promise to update the plan every year.
- Government measures include R&D, data centres, skills, international norms, guidelines aligned with international norms, investigating cases where rights are infringed, and giving guidance or advice to businesses.
- Under Article 13 the Headquarters adopted the Guideline for Ensuring the Appropriateness of AI R&D and use (19 Dec 2025). It is voluntary and risk-based and asks businesses to run AI governance, be transparent and ensure safety.
- The detailed practical playbook for companies remains the MIC/METI AI Guidelines for Business (Ver1.0 April 2024, latest Ver1.2 March 2026). These are voluntary.
Who it applies to
- Government, local governments, research institutes, business operators that develop, provide or use AI, and citizens (each gets a responsibility clause).
- No explicit extraterritorial clause in the outline. Foreign firms serving Japan are in practice treated as business operators for guidance purposes (Not stated in the source; inference).

Penalties and enforcement
- No penalties. The government may collect information, investigate rights-infringing cases, and give guidance, advice and public announcements.
- Supplementary provisions require the law to be reviewed, and the second Basic Plan commits to keep reviewing the AI Act itself.
What it means for an Indian company
- No registration or approval needed to sell AI into Japan, but Japanese clients (banks, manufacturers) increasingly expect alignment with the AI Guidelines for Business in contracts and vendor questionnaires.
- Map your programme to the Guidelines' themes: governance SC-AI-001 AI governance policy approved by the board or top management, risk assessment SC-AI-005 AI risk assessment, transparency SC-AI-025 Public AI transparency statement and notices, security SC-AI-029 AI-specific security controls (prompt injection, model abuse).
- Be ready for a government information request if a harm occurs: keep logs and incident records (SC-AI-031 AI incident management and regulator reporting, SC-AI-032 Logging and record keeping).
- Reputational risk (public naming) matters more than legal risk for Japanese customers.
- Track the yearly Basic Plan updates in your applicability register (SC-AI-009 Regulatory applicability register and horizon scanning).
